1. Use of Service

1.1 You agree to use Pixelfork only for lawful purposes and in accordance with these Terms. You may not use the platform to violate any applicable laws or rights of others.

1.2 You must register with a valid email address to access core features. You are responsible for safeguarding your account credentials.

1.3 You retain ownership of the content you create using Pixelfork (e.g. games, assets, prompts). You may use your outputs commercially and non-commercially.

1.4 You may not use content generated via Pixelfork to train or fine-tune your own machine learning models unless you obtain our written consent.

2. Platform Features & Fair Use

2.1 We may modify, add, or remove features, limitations, pricing, or functionality to improve the platform or ensure operational sustainability.

2.2 Automated, scripted, or programmatic access to Pixelfork (e.g. scraping or bot usage) is prohibited unless you have written permission for API access or a commercial agreement.

2.3 We reserve the right to enforce fair use limits to protect service availability for all users.

3. Payments & Subscriptions

3.1 Some features may require payment via third-party processors such as Stripe. All payment information is handled securely by the processor and is subject to their terms.

3.2 Prices, plans, and billing terms may change. Changes will be communicated in advance and require user acceptance for renewal.

3.3 Refunds are issued only at our discretion and are subject to the terms of the purchase agreement at time of transaction.

4. Ownership and Intellectual Property

4.1 Pixelfork and its core systems, including UI, backend architecture, and proprietary tools, are the intellectual property of Pixelfork OÜ or its licensors.

4.2 You may not copy, distribute, resell, or reverse-engineer any part of the Pixelfork platform without express written permission.

4.3 You are solely responsible for ensuring your generated content complies with all applicable laws, including copyright, privacy, and export regulations.

4.4 We do not use your prompts, assets, or game content to train or improve our models unless you provide explicit written consent.

5. OpenRAIL-M License

5.1 Use of Pixelfork is subject to the OpenRAIL-M License. This license governs acceptable use of outputs generated by AI and other platform-integrated models.

5.2 In the event of a conflict between these Terms and the RAIL-M License, the more restrictive provisions will apply.

6. Disclaimers

6.1 Pixelfork is provided "as is," without warranty of any kind. We disclaim all warranties, express or implied, including fitness for a particular purpose or non-infringement.

6.2 We do not guarantee uninterrupted access, platform stability, or output suitability for any particular use.

7. Limitation of Liability

7.1 To the maximum extent permitted by law, Pixelfork shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform.

7.2 Our total aggregate liability for any claim shall not exceed the amount you paid (if any) in the preceding 6 months.

8. Account Suspension & Termination

8.1 We reserve the right to suspend or terminate your account without notice if you violate these Terms, abuse the platform, or create risk or legal exposure for us or others.

8.2 You may delete your account at any time via messaging us at support@pixelfork.art

9. Governing Law

9.1 These Terms are governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles.

9.2 Any legal dispute shall be brought before the courts located in Tallinn, Estonia, unless otherwise required by applicable law.
